Terms of Service

Please read these terms carefully before using KindSquare.

1. Acceptance of Terms

By accessing or using KindSquare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms apply to all users, including Coordinators who create volunteer opportunities and Volunteers who commit to them.

2. Description of Service

KindSquare is a volunteer commitment management platform designed to help organizations coordinate recurring volunteer roles. The Service includes:

  • Creating and managing recurring volunteer opportunities (commitment series)
  • Facilitating volunteer sign-ups through shareable links
  • Sending automated email reminders before each commitment instance
  • Allowing volunteers to skip specific dates
  • Providing coverage dashboards for coordinators

3. User Accounts and Roles

Account Creation

To use the Service, you must:

  • Be at least 13 years of age
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update your account information if it changes

Volunteer Users

As a Volunteer, you agree to:

  • Make commitments in good faith
  • Honor your commitments or use the skip feature if you cannot attend
  • Provide accurate contact information
  • Communicate respectfully with coordinators and other volunteers

Coordinator Users

As a Coordinator, you agree to:

  • Provide accurate information about volunteer opportunities
  • Use volunteer information only for coordinating activities
  • Respect volunteer privacy and comply with data protection laws
  • Not use the Service for any illegal or unauthorized purpose

4. User Responsibilities

Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Impersonate another person or entity
  • Harass, abuse, or harm other users
  • Spam, phish, or send unsolicited communications
  • Upload viruses, malware, or malicious code
  • Attempt to gain unauthorized access to the Service
  • Scrape, crawl, or harvest user data without permission
  • Interfere with or disrupt the Service or servers

Content Standards

All content you provide must be:

  • Accurate and truthful
  • Appropriate for all ages
  • Free of hate speech or discriminatory language
  • Respectful of intellectual property rights

5. Commitments and Cancellations

For Volunteers

When you commit to a volunteer role, you are committing to all recurring instances of that role, not individual dates. We encourage you to:

  • Only commit to roles you can reasonably fulfill
  • Use the skip feature as early as possible if you cannot attend
  • Communicate directly with coordinators about special circumstances

For Coordinators

You may modify or cancel commitment series, but should communicate changes to affected volunteers promptly.

6. Service Availability

We strive to provide reliable service, but we do not guarantee that:

  • The Service will be available 100% of the time
  • The Service will be error-free or uninterrupted
  • All features will work perfectly at all times

We may perform maintenance that temporarily interrupts service. We will provide notice when possible, but emergency maintenance may occur without warning.

7. Intellectual Property

Our Rights

KindSquare, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of any content you submit. By using the Service, you grant us a license to use, store, and display your content solely for providing and improving the Service.

8. Fees and Payment

KindSquare is currently offered free of charge during our beta period. We reserve the right to introduce paid plans in the future. If we do:

  • We will provide advance notice (at least 60 days)
  • Existing users will receive grandfathered pricing options
  • A free tier will always be available
  • You may cancel at any time before paid plans begin

9. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review the Privacy Policy carefully.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or correctness of data

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINDSQUARE SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or goodwill
  • Damages resulting from unauthorized access to your account
  • Damages resulting from errors, omissions, or interruptions in service

Our total liability to you for any claims shall not exceed the amount you have paid us in the past 12 months (currently $0).

12. Indemnification

You agree to indemnify and hold harmless KindSquare from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Service

13. Termination

By You

You may stop using the Service and delete your account at any time through your account settings.

By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account has been inactive for more than 2 years
  • Required by law or legal process

We will provide notice before termination when possible, except in cases of serious violations or legal requirements.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by:

  • Updating the "Last Updated" date at the top
  • Sending you an email notification
  • Displaying a prominent notice on the Service

Your continued use of the Service after changes become effective means you accept the updated Terms.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions.

We encourage you to contact us first if you have any disputes. We will make every effort to resolve issues amicably.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KindSquare regarding the Service.
